These terms and conditions govern the purchase of photography and ecotourism services offered by Fotogario (hereinafter, "the Company"). By purchasing any of our services, the client (hereinafter, "the Client") accepts and agrees to comply with the following conditions.
1. Purpose and Scope of the Service
Fotogario specializes in organizing photography and ecotourism experiences in natural settings, focusing on wildlife observation and photography. Services include, but are not limited to:
- Photo tours: Guided excursions to Natural Parks and other areas of interest, with a focus on nature photography.
- Workshops and courses: Training sessions on wildlife photography techniques and animal behavior.
- Tailor-made experiences: Customized services for groups or individuals, based on the Client's specific needs.
2. Reservation and Payment
- Booking: To formalize a reservation, the Client must pay a percentage of the total price of the service. The exact amount and payment methods will be specified at the time of booking.
- Final payment: The remaining amount must be paid by the deadline indicated by the Company. If payment is not received within the established period, the reservation may be canceled.
- Prices: All prices are expressed in euros (€) and include applicable taxes, unless otherwise indicated. Prices do not include personal expenses, transportation, accommodations, or meals, unless explicitly stated in the description of the contracted service.
3. Cancellation Policy
Cancellation by the Client:
- If cancellation is made more than 30 days in advance, 100% of the amount paid will be refunded.
- If cancellation is made between 15 and 30 days before the start of the service, 50% of the amount paid will be refunded.
- If cancellation is made less than 15 days in advance, no refund will be issued.
Cancellation by the Company:
Fotogario reserves the right to cancel a service if weather, safety, or any other circumstance beyond the Company's control prevents its proper execution. In this case, an alternative date will be offered or the Client will be fully refunded.
4. Customer Responsibility and Conduct
- Respect for the environment: The Client agrees to follow the guide's instructions at all times and maintain respectful behavior toward nature, wildlife, and other participants. This includes avoiding loud noises, not disturbing the animals, not leaving trash, and not straying from marked trails.
- Photographic ethics: Responsible photographic ethics are encouraged. The use of direct flash or any other technique that could cause stress or disturb the animals is strictly prohibited. The goal is to "capture without disturbing."
- Inherent risks: The Client is aware that outdoor activities carry inherent risks. Fotogario is not responsible for accidents, injuries, or personal damage that may occur during the activity, provided they are not the result of negligence on the part of the Company. The Client is recommended to purchase travel and accident insurance.
5. Intellectual Property
- Photographic material: The Client retains all copyrights to any photographs taken during the service.
- Use of images: Fotogario may request permission from the Client to use some of their photographs for promotional purposes, always with due acknowledgement of the author.
6. Data Protection
In compliance with current regulations, the Client's personal data will be treated with the utmost confidentiality and will only be used to manage the reservation and provide the service. For more details, please see our Privacy Policy.
7. Applicable Law and Jurisdiction
These terms and conditions are governed by Spanish law. For the resolution of any dispute that may arise, the parties submit to the courts and tribunals of the city where Fotogario has its registered office, waiving any other jurisdiction that may apply.
